Kya farmaate hain ‘ulamaa-e-deen aur muftiyaan-e-shar‘e mateen masla-e-zael mein:
Ghausuddeen ki family mein Ghausuddeen, unki beewi Raziya, unke teen bete Feroz, Siraaj, ‘Usmaan aur ek beti Aamna hai.
Ghausuddeen ke paas Muslim B mein ek ghar hai aur Masjid Bandar mein ek office hai. Gao.n mein ek ghar hai aur gao.n mein 8 acre zameen bhi hai.
2003 mein Ghausuddeen, Siraaj aur ‘Usmaan ke mushtarka rupiyo.n se Diamond Hill par do ghar kharide gae. Ek ghar Ghausuddeen ke naam par Khareeda gaya aur duusra ghar Siraaj ke naam par Khareeda gaya.
2007 mein ek dukaan Ghausuddeen, Siraaj aur ‘Usmaan ke mushtarq
ka rupiyo.n se Feroz ke naam par Khareedi gai jisme Feroz ab tak clinic chalaate hain.
2010 mein Ghausuddeen, Feroz, Siraaj aur ‘Usmaan ke mushtarka rupiyo.n se do flats Feroz aur ‘Usmaan ke naam par kharide gae. Jisme.n 10 percent rupay Feroz ne ada kiye aur baaqi Ghausuddeen, Siraaj aur ‘Usmaan ne ada kiye. Yeh ghar abhi mila nahi.n hai.
2005 mein Ghausuddeen, Siraaj aur ‘Usmaan ke mushtarka rupiyo.n se Vashi mein ek office Khareedi gai saat lakh rupay ki. 2015 mein yeh office waalid sahaab ke naam kar di gai jisme 5-6 lakh ka kharcha aaya. Yeh paisa Ghausuddeen aur ‘Usmaan ne diya.
2013 mein Kurla West mein ek crore bees lakh rupay ki ek dukaan Ghausuddeen ke naam par Khareedi gai. Ismein Ghausuddeen, Feroz, Siraaj aur ‘Usmaan ka mushtarka paisa laga. Is office ke liye 60 lakh rupay ka loan liya gaya tha jiski adaaigi Ghausuddeen aur ‘Usmaan ne ki thi.
2014 mein Siraaj ne Ghausuddeen, Siraaj aur ‘Usmaan ke mushtarka paiso.n mein se 5 lakh 25 hazaar rupay le kar alag ho gae. Siraaj ne bataaya ki unho.ne ismein se 2 lakh 60 hazaar rupay se ‘Usmaan ka ek qarz ada kiya.
2014 mein Ulwe mein ek ghar Khareeda gaya tha down payment par. Down payment ki raqam Ghausuddeen, Siraaj, Feroz aur ‘Usmaan chaaron ne ada ki thi, lekin baqiya raqam Ghausuddeen, Feroz aur ‘Usmaan ne ada ki.
2017 mein Ulwe ka ghar bech kar 35 lakh mein Raziya ke naam par Vashi mein ek office Khareedi gai.
March 2017 mein Feroz ghar se alag ho gae.
2017 mein Ghiyasuddeen ke naam par gaon mein ek zameen Khareedi gai 30 lakh rupay ki, yeh raqam Ghausuddeen aur ‘Usmaan ne ada ki.
2018 mein Ghausuddeen aur ‘Usmaan ke paiso.n se ‘Usmaan ke naam par ek office Khareedi gai.
2018 mein Ghausuddeen ke naam par Galaxy mein 2BHK ka ek ghar Khareeda gaya jiska paisa Ghausuddeen aur ‘Usmaan ne diya.
2018 mein Feroz ne apne walid Ghausuddeen se kaha ki maine 11 lakh jama’ kiye hain, mujhe bhi ek ghar dila do. Is par Ghausuddeen ne 28 lakh 75 hazaar rupay ki maali madad ki. Baqiya loan ki raqam Feroz ada kar rahe hain.
2014 mein Ghausuddeen, Siraaj aur ‘Usmaan ke mushtarka rupiyo.n se paanch gaadiyaa.n Khareedi gai aur gaadiyo.n par jo loan tha uski adaaigi Ghausuddeen aur ‘Usmaan ne ki.
December 2014 mein woh paanchon gaadiyaa.n bech kar do gaadi Khareedi gai jis ka loan bhi Ghausuddeen aur ‘Usmaan ne ada kiya.
2016 mein phir teen gaadiyaa.n Khareedi gai jis ka pura loan bhi Ghausuddeen aur ‘Usmaan ne ada kiya.
2017 mein do gaadiyaa.n aur Khareedi gai iska loan bhi Ghausuddeen aur ‘Usmaan ne hi diya.
2018 mein chaar gaadiyaa.n aur Khareedi gai iska loan bhi Ghausuddeen aur ‘Usmaan ne hi diya.
Ghausuddeen ke paas ab kul nau (9) gaadiyaa.n hain.
2020 mein Siraaj ne Ghausuddeen se kaha ki Diamond Hill par jo ghar mere naam par hai usse bech kar uski qeemat mujhe de di jaae. Ghausuddeen ne kaha ki woh ghar tum ‘Usmaan ke naam kar do, uski qeemat jo bhi hogi main tumhe.n de duu.nga. Us waqt ghar ki qeemat 75 lakh thi, usse 12 lakh zyaada ya’ni 87 lakh rupay Siraaj ko diye gae aur Siraaj ne ghar ‘Usmaan ke naam kar diya.
2020 mein gao.n ki zameen tees lakh mein bech kar bees lakh aur mila ke kul 50 lakh rupay builder ko ek ghar ke liye diye gae. Ba’d mein us ghar ka plan cancel kar diya gaya. Ab builder se 50 lakh rupay wapas lene hain. Ghausuddeen ka iraada hai ki tees lakh rupay se masjid ki ta’meer mein hissa liya jaae.
Ab Mufti Sahaab Qibla, ham sabhi log aap se kuch sawaalaat karna chaahte hain. Aap unke jawaabaat sharee’at ki roshni mein deejiye.
Ghausuddeen ka kehna hai:
Kulsum Bi ke ghar aur Masjid Bandar ke office ko chhod kar baaqi jitni bhi property hai uske 5 hisse karke ek hissa Ghausuddeen aur unki beewi rakhengi, aur baaqi 4 hisso.n mein se ek ek hissa Feroz, Siraaj, ‘Usmaan aur Aamna ko diya jaaega.
Gaadiyo.n ke baare mein aur business ka jo naam hai us ke baare mein faisla Ghausuddeen ba’d mein kare.nge.
Feroz ka yeh kehna hai:
Waalid sahaab behen ko bhaaiyo.n ke baraabar hissa de rahe hain jabki waalid sahaab ko behen ko bhaiyo.n se aadha dena chaahiye. Feroz ka yeh bhi sawaal hai ki 2017 ke ba’d jo raqam Feroz ne aur unki beewi ne kamaai hai aur jo ghar kiya, use bhi Ghausuddeen ki milkiyat kaha jaaega? Kya uski bhi taqseem hogi ya nahi.n. Aur yeh ki woh ghar jo 2018 mein Feroz ne Khareeda hai, kya woh Feroz ka hai ya waalid sahaab ka? Feroz ka yeh bhi kehna hai ki jab jaidaad ki taqseem ho rahi hai to business ki bhi taqseem honi chaahiye taaki insaaf ho sake.
Siraaj ka kehna hai:
Jaidaad ki taqseem ke saath-saath business ki bhi taqseem honi chaahiye.
Waalid sahaab mujhe “Maharashtra Andhra Roadways” de.n.
‘Usmaan ko “Maharashtra Andhra Logistics” de.n.
Aur waalid sahaab ko gaadiyo.n ki bhi taqseem kar deni chaahiye, taaki bachchon ke darmiyaan insaaf ho aur ba’d mein fitna na ho.
Aur Feroz ke liye koi aise zari’e ka intezaam kare.n jisse uska business ho sake aur woh mutmain ho sake.
Iske ‘alaawa bhaabhi ko bhi kuch hissa dena chaahiye, kyu.nki unho.ne 10 saal tak apni doctori ki kamaai waalid sahaab ko di thi.
Aur agar waalid sahaab bhaabhi ko kuch nahi.n dete to phir woh paise jo waalid sahaab ne bhaabhi se liye the, woh unhe.n lautaa de.n. Taaki ba’d mein koi waalid sahaab ko yeh ta’na na de ki waalid sahaab bahu ki kamaai khaate the.
‘Usmaan ka kehna hai:
2014 se pehle jitni bhi property hai, usmein Ghausuddeen jis tarah chahe.n taqseem kare.n, Lekin 2017 ke ba’d jitni bhi property Khareedi gai hai, usmein Ghausuddeen aur ‘Usmaan ka aadha-aadha hissa hai. Ismein bhaiyo.n aur beheno.n ko hissa dena ghalat hai.
Mufti Sahaab Qibla se guzaarish hai ki inmein se kiski baat sahi hai, iske baare mein sahiih jawaab sharee’at ki roshni mein de.n. Sharee’at ka jo bhi hukm hoga, woh ham sab ko manzuur hoga.

Jawaab:
2018 mein Feroz ne jo ghar Khareeda hai, uske ‘alaawa jitni bhi jaidaad hai, un sab ke maalik Ghausuddeen hi hain. Woh jis tarah chaahe.n, taqseem kar sakte hain. Jo tareeqa unho.n ne bataaya hai ki paanch hisse karke khud ke aur apni beewi ke liye ek hissa rakh kar, baaqi chaar hisso.n mein se Feroz, Siraaj, ‘Usmaan aur Aamna ko ek ek hissa dena chaahte hain, is tarah bhi woh taqseem kar sakte hain. Aur unhe.n is ka bhi ikhtiyaar hai ki gaadiyo.n aur business ki taqseem ba’d mein kare.n.
Feroz ka yeh kehna ghalat hai ki behan ko bhaaiyo.n se aadha milna chaahiye. Kyu.nki jab baap apni zindagi mein jaidaad taqseem karta hai, to usay beti aur bete ko baraabar hi dene ka hukm hai.
Fataawa-e-Hindiyyah mein hai:
“یعطی الابنۃ مثل ما یعطی للابن، وعلیہ الفتویٰ، وھکذٰ فی فتاویٰ قاضی خان. (الفتاوی الھندیہ ،ج :4،ص:391)واللہ تعالی اعلم

Wallaahu Ta'aala A’lam.
Woh ghar jo Feroz ne Khareeda hai, woh usi ka hai, usme duusro.n ka haq nahi.n. Haa.n waalid Ghausuddeen ne agar 28 lakh 75 hazaar rupay Feroz ko qarz ke taur par diye the, to woh itni raqam ka mutaalba kar sakte hain. Aur agar unho.n ne who raqam feroz ko hadiya (gift) ke taur par diya tha to unhe.n itni raqam Feroz se wapas nahi.n lena chaahiye.
2017 ke ba’d se jo kamaai Feroz aur unki beewi ne ki hai, woh bhi sirf un dono ki hai. Usme.n duusro.n ka koi hissa nahi.n

Kyu.nki jab baap aur bete ek saath koi business karte hain, to aisi suurat mein maal saara ka saara baap ka hota hai bete ka nahi.n, Beti ki haisiyat mu’aawin aur madadgaar ki hoti hai.
Fatawa-e-Hindiyyah mein hai:
" اب و ابن یکتسبان فی صنعۃ واحدۃ و لم یکن لھما مال ،فالکسب کلہ للاب ، اذا کان الابن فی عیال الاب،لکونہ معینا لہ ۔الا تری انہ لو غرس شجرۃ تکون للاب۔(الفتاوی الھندیہ،ج:2،ص:329)واللہ تعالی اعلم

Wallaahu Ta’aala A’lam.
Agar Ghausuddeen chaahe.n to Siraaj ki baat par ‘amal kar ke business aur gaadiyo.n ko bhi taqseem mein shaamil kar sakte hain, taaki insaaf mukammal ho jaae. Aur agar woh aisa nahi.n karna chaahte, to bache unpar koi zor zabardasti nahi.n kar sakte.

Feroz ki beewi ne jo das saal tak Ghausuddeen ko rupay diye hain, agar usne bataur qarz diye the to Ghausuddeen ko woh rupay wapas kar dene chaahiye Aur agar ghar chalaane ke liye hadiya ke taur par diye the to Feroz ki beewi ko haq nahi.n poho.chta ki woh iska mutaalba kare.n. Haa.n, agar Ghausuddeen chaahe.n to apni jaidaad me.n se kuch hissa Feroz ki beewi ko de sakte hain, aur agar na dena chaahe.n to unpar koi zabardasti nahi.n kar sakta.
