Us ke baa’d 20/07/2019 ko dobaarah susraal aai aur 10/08/2019 ko ‘Eed manaane apne maa.n baap ke ghar waapas chali gai. Is ke baa’d dobaarah susraal aane se inkaar kar diya. Baa’d mein Hinda ne apne shauhar ke khilaaf court mein "haraasaa.n karne waghairah" ka case bhi kar diya. Fareeqain ke maabain sulah wa samjhauta ki koshish bhi ki gai, nateejah yeh hua ki Hinda apne shauhar se talaaq ka mutaalbah karne lagi. Zaid chaahta hai ki khula’ ya talaaq na ho aur sulah ho jaae, lekin Hinda talaaq lene par musir hai. Neez, Hinda ki taraf se ek lakh sattar hazaar naqad(cash) lene ka mutaalba kiya ja raha hai. Zaid is ke badle jahez ka samaan waapas karne ke liye raazi hai, lekin Hinda is ke badle ek lakh sattar hazaar rupae naqad(cash) lene par musir hai. Daryaaft talab-e-amr yeh hain ki: (1) Hinda ka mutaalba shar'an durust hai ya nahi.n? (2) Jahez ke saamaan ki waapsi khula’ ke liye kaafi hai ya nahi.n? (3) Zaid ke ahl-e-khaana ki jaanib se Hinda ko jo zewaraat diye gae, us ka shar'ee haqdaar aur maalik kaun hai? (4) Khula’ ki woh kaun si suurat hai jo fareeqain ke liye aasaan tar ho? ﷽ Al-Jawaab: (1) Jab Zaid jahez ka saara saamaan lautaane ke liye tayyar hai, to Hinda ka is se ek lakh sattar hazaar rupae ka mutaalba karna shar’an durust nahi.n. Wallaahu Ta'aala Aa'lam Bis-Sawaab (2) Khula’ ke liye jahez ka ssamaan waapas kar dena kaafi hai. Wallaahu Ta'aala Aa'lam Bis-Sawaab (3) Mehr ke ‘ilaawah jo zewaraat shauhar ke ahl-e-khaana bahu ko dete hain, woh hamaare yahaa.n Hindustaan mein mehez pehenne aur iste’maal karne ke liye dete hain, bahu ko un zewaraat ka maalik nahi.n banaate hain. Is liye hamaare Hindustaan ke ‘urf ke lihaaz karte hue un zewaraat ke maalik shauhar ke ghar waale hain. Fataawa Shaami mein hai: والمعتمد البناء علی العرف، کما علمت۔(کتاب النکاح، باب المھر،ج:3،ص:157) Fataawa Razwiyyah mein hai: "Aur woh zewar waghairah ke waalidain-e-zauj apni bahu ke pehenne baratne dete hain jis mein nasan ya ‘urfan kisi tarah maalik kar dena maqsuud nahi.n hota, woh badastuur milk-e-waalidain par hai, bahu ka us mein kuch haq nahi.n." کما تقدم فی استمتاع المرأۃ بمشری الزوج اس کے احکام وہ ہی احکام عاریت ہیں۔ (Jild: 12, Page: 209 & 210) (4) Khula’ ka aasaan tareeqah yeh hai ki fareeqain, unke ghar waale aur ‘ilaaqe ke bade log kisi jagah baith kar khula’ kara le.n. Ladki ki taraf se ek kaaghaz banwaae.n jis mein ladki khula’ ka mutaalbah kare aur ladka is mutaalbah ko qubuul kare. Us kaaghaz mein is cheez ki bhi saraahat ho ki ladki kis cheez ke ‘ewaz khula maang rahi hain, ya’ni ladki khula’ ke ‘ewaz ladke ko kya degi. Shar’an mehr se zyaada qeemat lena ladke ke liye durust nahi.n. Kaaghaz mein is ki saraahat kar di jaae ki ladke waale jahez ka saamaan wapas kar rahe hain. Phir is kaaghaz par fareeqain aur do gawaaho.n ke dastakhat le liye jaae.n.
